This policy outlines how we collect, use, disclose, and protect your information, in compliance with privacy legislation including the Freedom of Information and Protection of Privacy Act (FIPPA) of British Columbia and principles based on Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

Collection of Personal Information

 We collect personal information necessary to conduct our investigative services, which may include:

  • Name, address, and contact information
  • Date of birth
  • Employment history
  • Claim-related information
  • Surveillance footage and photographs
  • Witness statements

 

We collect personal information by fair and lawful means. Wherever possible we collect information with consent. Personal information maybe collected without consent in accordance with applicable law.

Use of Personal Information

 We only use or disclose personal information for the purposes for which that information was collected, or as otherwise permitted or required by law.

We use personal information as necessary to provide and deliver our services to our clients.

We use personal information for the following purposes:

  • Conducting surveillance, background checks, and other investigations
  • Verifying insurance claims
  • Communicating with clients, witnesses, and other relevant parties
  • Complying with legal and regulatory requirements

 

We are committed to protecting personal information in order to prevent unauthorised access, collection, use, disclosure, and copying. We use reasonable physical, technical and security measures to protect personal information.

Storage and Security of Personal Information

We take appropriate measures to ensure the security and confidentiality of the personal information stored for data backups. This includes security measures to prevent unauthorised access, loss or misuse of personal information.

Accessing your personal information

 We respect your right to access your personal information to ensure the information is accurate.

Retention of Personal Information

 We store your personal information for as long as is necessary to provide our services to clients and business partners and to comply with our legal and regulatory requirements. Once no longer required, your personal information will be securely destroyed.

In accordance with our ICBC contract we retain personal information related to data backups for up to 7 years. The information is secured on an external hard drive. External hard drives are encrypted and stored in a secure location and secure safe in the office of Mark and Ilona Kusic located at 699 Cardero Street in Vancouver. The location is protected by a security system, security cameras and security door which requires a passcode to enter. This material is only accessible by the Director and Managing Director of Kusic and Kusic Private Investigators, Ilona and Mark Kusic. At the end of the seven (7) years external hard drives are shredded and permanently destroyed using the services of a bonded shredding company. The hard drives can never be retrieved or reconstructed. This is a secure destruction of computer data. 

Disclosure of Personal Information

We will limit the collection of personal information to what is necessary for the purposes identified. We will not use or disclose personal information for purposes other than those for which it was collected, except with your consent or as required by law.

Personal information will be retained only as long as necessary for the fulfillment of those purposes or as required by law.

We will not use or disclose your personal information other than for the purposes for which it was collected unless we receive your consent or unless we are required or permitted by law. The content of the files stored on our services are encrypted. We will make reasonable efforts to notify you should your personal information be subject to disclosure.

We may disclose personal information related to data backups in the following circumstances:

  1. To comply with applicable laws, regulations or legal processes.
  2. To respond to lawful requests or legal authorities including government or public authorities.
  3. To protect the rights, property or safety of Kusic and Kusic Ltd, its user.

Accuracy

We will keep personal information as accurate, complete, and up-to-date as necessary for the purposes for which it is to be used.

Safeguards

We will protect personal information using security safeguards appropriate to the sensitivity of the information, including:

Physical: External hard drives in a secure office facility in Vancouver with security alarms, security cameras and coded access.

Technological: Encrypted storage on Sync Cloud Servers in Toronto and backup servers in Toronto.

Organizational: Policies and procedures, training for staff on privacy practices.

Third-Party Providers

We use Sync Cloud Servers located in Toronto for the storage of personal information. Sync complies with PIPEDA, FIPPA, PIPA, PHIPA, ATIPPA & FOIPOP and has its own privacy policies and safeguards in place. We ensure that any third-party service providers also adhere to privacy standards equivalent to ours.

Changes to this Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices or for other operational, legal, or regulatory reasons.
